New European Regulation (EU) 2016/425

On March 31st 2016, the European Commission published new Personal Protective Equipment (PPE) legislation as Regulation (EU) 2016/425. This will replace the current PPE Directive 89/686/EEC which has required all PPE placed on the European market since 30th June 1995 to be CE marked.
During the last 22 years, hundreds of thousands of models of PPE have gone through the certification process under the current PPE Directive and millions of individual products have subsequently been CE marked and sold all across Europe. However, to continue placing these products on the market they will have to be certified to the new Regulation and after 21st April 2019 it will be illegal to place on the market any item of PPE that has not been certified to the new Regulation. The scale of this recertification task is potentially enormous and will require careful planning and managing to ensure a smooth transition and to minimize any disturbance to the market.

Article 2 Scope (적용대상)
1.This Regulation applies to PPE.
2.This Regulation does not apply to PPE:
(a) specifically designed for use by the armed forces or in the maintenance of law and order;
(b) designed to be used for self-defence, with the exception of PPE intended for sporting activities;
(c) designed for private use to protect against:
(i) atmospheric conditions that are not of an extreme nature,
(ii) damp and water during dishwashing; (설거지용 고무장갑 등은 제외)
(d) for exclusive use on seagoing vessels or aircraft that are subject to the relevant international treaties applicable in Member States;
(e) for head, face or eye protection of users, that is covered by Regulation No 22 of the United Nations Economic Commission for Europe on uniform provisions concerning the approval of protective helmets and their visors for drivers and passengers of motorcycles and mopeds.
Article 19 Conformity assessment procedures 적합성평가절차
The conformity assessment procedures to be followed for each of the risk categories set out in Annex I are as follows:
(a) Category I: internal production control (module A) set out in Annex IV;
(b) Category II: EU type-examination (module B) set out in Annex V, followed by conformity to type based on internal production control (module C) set out in Annex VI;
(c) Category III: EU type-examination (module B) set out in Annex V, and either of the following:
(i) conformity to type based on internal production control plus supervised product checks at random intervals (module C2) set out in Annex VII;
(ii) conformity to type based on quality assurance of the production process (module D) set out in Annex VIII. By way of derogation, for PPE produced as a single unit to fit an individual user and classified according to Category III, the procedure referred to in point (b) may be followed.

EU 개인보호구 규정은 현행 개인보호구 지침을 대체하게 되며 2년간의 유예기간을 거친 후 2018년 4월 21일 시행될 예정입니다.

개인보호구 규정의 주요 내용은 아래와 같습니다.
ㅇ 개인보호구 정의
- 인간의 건강 및 안전에 대한 하나 이상의 위험 요소로부터 보호하기 위해 착용하거나 소지하도록 설계되고 제조된 장비
- 보호기능에 필수적이며, 교체 가능한 보호장비 부품
- 사람이 착용하거나 소지하지 않는 부품으로, 사용 전 별도 체결이 필요하지 않고 영구적으로 고정되지 않은 연결부위 또는 외부 기기에 연결되도록 설계된 보호구 연결시스템
- 인간의 건강 및 안전에 대한 하나 이상의 위험 요소로부터 보호하기 위해 착용하거나 소지하도록 설계되고 제조된 장비
- 보호기능에 필수적이며, 교체 가능한 보호장비 부품

ㅇ 주요 의무
- 개인보호구 제조자는 제품 출시 전, 개인보호구 규정 부속서II의 안전요건을 준수하고, 부속서III에 명기된 요소를 포함한 기술문서 및 제품 적합성 선언서를 보유해야 하며, CE마크를 부착해야 함
- 개인보호구 제조자는 제품 출시 전, 개인보호구 규정 부속서II의 안전요건을 준수하고, 부속서III에 명기된 요소를 포함한 기술문서 및 제품 적합성 선언서를 보유해야 하며, CE마크를 부착해야 함
- 개인보호구 수입자는 규정을 준수한 개인보호구만 유통시켜야 하며, 시장 출시 전 제조자의 적합성 평가 절차 준수 여부를 확인해야 함
- 개인보호구 수입자는 제품 보관 또는 유통 시 품질에 문제가 발생하지 않도록 관리해야 하며, 출시된 제품의 적합성 선언서 및 기술문서를 10년 이상 보관하고 관계 당국의 요청에 따라 관련 정보를 제공해야 함
- 개인보호구 유통업자는 제품 유통 전, 제품에 CE마크와 사용 가이드가 부착되어 있는지 확인해야 함
- 개인보호구 유통업자는 규제 부적합 제품임이 확인될 때에 제품 철수 또는 회수 조치를 취해야 함
- 개인보호구 유통업자는 제품 유통 전, 제품에 CE마크와 사용 가이드가 부착되어 있는지 확인해야 함
- 개인보호구 유통업자는 규제 부적합 제품임이 확인될 때에 제품 철수 또는 회수 조치를 취해야 함
ㅇ 주요 변경 사항
- 구명조끼, 청력 보호구를 분류II(중간 보호구)에서 분류 III(복합 보호구)으로 이동
- 적합성 선언서는 최대 5년간 유효하며, 적합성 선언서와 기술문서는 10년 이상 보관해야 함
- 방열, 방습, 방수용의 맞춤형 개인보호구(설거지용 고무장갑 등은 제외)를 대상범위에 신규 추가
- 제3자 인증의 제품 적합성 선언서 제공 의무화
- 수입자 및 유통업자 의무 부여
